1. Agreement to Terms
By accessing or using the Tija Kids mobile application, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and Tija Kids ("Company," "we," "our," or "us"). The Service is operated from Kenya and governed by Kenyan law.
2. Eligibility
2.1 Age Requirements
- Parents/Guardians: You must be at least 18 years old to create a parent account
- Children: Under Kenyan law every person under 18 is a child. Child profiles can only be created and controlled by a parent or guardian, who must provide consent for the child's use of and data processing within the Service
- Co-Parents/Guardians: Must be at least 18 years old and invited by the primary account holder
2.2 Account Responsibility
Parents/guardians are responsible for:
- All activity under their account and linked child accounts
- Maintaining the confidentiality of account credentials
- Supervising their children's use of the Service
- Ensuring accuracy of account information
3. Description of Service
Tija Kids is a family task management and financial education application that allows:
- Parents to assign tasks to children with virtual currency rewards
- Children to complete tasks and earn TijaBucks (virtual currency)
- Families to manage rewards and redemptions
- Financial literacy education through gamification
4. Virtual Currency (TijaBucks)
- TijaBucks are earned by completing tasks assigned by parents
- TijaBucks can only be redeemed for rewards set by parents within the household
- TijaBucks balances are not transferable between households
- We reserve the right to modify, reset, or remove TijaBucks balances
- TijaBucks have no cash value and cannot be sold or traded
5. User Accounts
5.1 Account Creation
To use certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information
- Keep your password and PIN codes secure
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
5.2 Account Types
- Parent Account: Full access to household management, task creation, and settings
- Co-Parent Account: Equal access to parent features within the household
- Guardian Account: Limited access for task approval only
- Child Account: Access to complete tasks, view wallet, and redeem rewards
5.3 Account Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Abuse or misuse the Service
You may delete your account at any time through the app settings or by contacting us.
6. Pricing
- Tija Kids is free to use. All features — including unlimited children, multi-parent coordination, tasks, rewards, and savings tools — are available at no cost.
- There are no subscriptions, paid plans, trials, or in-app purchases.
- If we ever introduce optional paid features in the future, we will give you clear advance notice and you will never be charged without your express consent.
7. Acceptable Use
You agree NOT to:
- Use the Service for any illegal purpose
- Violate any applicable laws or regulations
- Impersonate any person or entity
- Interfere with or disrupt the Service
- Attempt to gain unauthorized access to any part of the Service
- Use automated systems to access the Service without permission
- Upload malicious code or content
- Harass, abuse, or harm other users
- Use the Service to collect personal information without consent
- Circumvent any security measures
8. Content and Intellectual Property
8.1 Our Content
The Service and its original content, features, and functionality are owned by Tija Kids and are protected by international copyright, trademark, and other intellectual property laws.
8.2 User Content
You retain ownership of content you create (task names, reward descriptions, etc.). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with the Service.
8.3 Feedback
Any feedback, suggestions, or ideas you provide may be used by us without obligation to you.
9. Children, Parental Consent & Best Interests
Tija Kids is designed for families. Because children use the Service, the following terms apply:
- Only a parent or guardian may create and manage a child's profile, and by doing so you confirm you have the authority to consent on the child's behalf.
- You consent to our processing of your child's personal data for the purposes described in our Privacy Policy, and you confirm such use is in the best interests of the child (Section 33, Kenya Data Protection Act, 2019).
- You are responsible for supervising your child's use of the Service and for the content (such as task and reward names) you create within your household.
- We do not show targeted advertising to children and do not sell or share children's data for marketing.
- You may review, correct, export, or delete your child's data at any time through the app or by contacting privacy@tija.kids.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not warrant that:
- The Service will be uninterrupted or error-free
- Defects will be corrected
- The Service is free of viruses or harmful components
- The results of using the Service will meet your requirements
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed one hundred US dollars (USD $100)
- We are not liable for any loss of data, profits, or goodwill
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Tija Kids, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you submit to the Service
14. Governing Law and Disputes
14.1 Governing Law
These Terms are governed by the laws of Kenya, without regard to conflict of law principles.
14.2 Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through:
- Negotiation: Parties shall first attempt to resolve disputes amicably
- Mediation: If negotiation fails, disputes shall be submitted to mediation in Nairobi, Kenya
- Arbitration: If mediation fails, disputes shall be resolved by binding arbitration under the Arbitration Act of Kenya
14.3 Class Action Waiver
You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.
15. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on this page
- Updating the "Last Updated" date
- Sending an email or in-app notification for significant changes
Continued use of the Service after changes constitutes acceptance of the new Terms.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tija Kids.
16.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
16.3 Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
16.4 Assignment
You may not assign your rights under these Terms. We may assign our rights without restriction.
16.5 Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control.
17. Kenya-Specific Provisions
In compliance with Kenyan law:
- Consumer rights under the Consumer Protection Act, 2012 are preserved
- Data protection rights under the Data Protection Act, 2019 apply, and you may complain to the Office of the Data Protection Commissioner (ODPC) at www.odpc.go.ke
- The protections afforded to children under the Children Act, 2022 and the Constitution of Kenya are respected
- Electronic acceptance of these Terms is recognised under the Kenya Information and Communications Act and the Business Laws (Amendment) Act
- Nothing in these Terms excludes liability that cannot be excluded under Kenyan law
